COCKTAIL MAIL’S TERMS & CONDITIONS
Cocktail Mail is owned by the Toby Eaton and Nicola Collins Partnership. Access to and use of Cocktail Mail’s website and online shop is subject to Cocktail Mail’s terms and conditions and these terms of use. By purchasing products and using our website you are deemed to have accepted our terms and conditions and terms of use.

GENERAL
Age Restriction
It is illegal to sell liquor to anyone under the age of 18, buy liquor when under the age of 18 and to make a false declaration of age in order to purchase liquor. It is also illegal to purchase alcohol as a gift for anyone under the age of 18 years. You warrant toCocktail Mail that, at the time of accessing the Cocktail Mail page, you are 18 years or over. Cocktail Mail may request documentation from you verifying your age. If you refuse Cocktail Mails’s request or Cocktail Mail is otherwise unable to verify that you are 18 years or over, Cocktail Mail may cancel your order. If Cocktail Mail cancels your order, Cocktail Mail will not be liable to you for any reason.

CHANGES TO TERMS AND CONDITIONS
We reserve the right to change any of the Terms and Conditions displayed on this website (including our Privacy Policy) at any time by notifying you through this website that we have done so. By continuing to use this website it shall be deemed that you agree to be bound by the amended terms and conditions as notified and posted on the website.
Guarantee
Cocktail Mail guarantees quality products and service. If, for any reason, you are dissatisfied with your order, please contact us within 24 hours of receipt of your order for customer care assistance by e-mail at hello@cocktailmail.co.nz or phone 03 550 1316

Refusal, Suspension or Termination
Cocktail Mail reserves the right to refuse registration of a potential customer on the basis of age or for any other reason.Cocktail Mail may also suspend or terminate any order for products made by any person for any reason.

Shortages or Breakages
Any shortages or breakages must be reported toCocktail Mail within 24 hours of delivery, preferably by phone call. Please ensure to quote your receipt number at the time of reporting.

Insurance
The products are insured by Cocktail Mail up until the actual time of delivery (being on receipt by the Courier of a signature)

PRODUCT RANGE/AVAILABILITY
Cocktail Mail will ensure every effort is made to fulfil any order, but you acknowledge that Cocktail Mail will not be liable to you if Cocktail Mail. is unable to fulfil or rejects any order for any reason. Products advertised are subject to stock availability.

SECURITY AND PRICING
Security
Cocktail Mail will use its reasonable endeavours to prevent any unauthorised access to this site.Cocktail Mail will not be liable to you for any damage, loss or costs incurred by you resulting from any person gaining unauthorised access.

Privacy Policy
Cocktail Mail’s online shop uses encryption protocol to encrypt and thus keep secure all personal data transmitted to and from this site (for example, credit card details).Cocktail Mail uses “Swipe HQ” to securely authorise credit card payments in real time. Once Swipe HQ  receives your personal data, it stores that data on a secure server so that it can not be accessed by any person.

Pricing
The prices for products will be the prices stated on this site at the time you submit your order. No upward or downward price adjustment will apply during the period from the time at which the order is submitted to completion of delivery of that order.

Product prices may vary from time to time without notice and at Cocktail Mail’s discretion.

To avoid doubt, all prices are stated in New Zealand currency and inclusive of GST and any other applicable sales tax.

Payment Terms
You must pay for products by credit card, or debit card Cocktail Mail will not accept any other method of payment.Cocktail Mail may change the payment method at any time and for any reason.

Once payment of your order is processed and accepted byCocktail Mail , Cocktail Mail will email you a GST receipt.

DELIVERY
Delivery Times
All orders and delivery times are subject to availability first, Cocktail Mail is by no means contracted to or liable for delivery times being longer than stated due to mitigating factors outside Cocktail Mail’s control.

Deadlines and Charges
All deliveries within New Zealand will be by Courier and direct to your door (except in some rural situations). The courier will require a signature by you or someone 18 years old or older upon delivery. If no one is home, the courier will leave a card requesting that you contact the courier office either to arrange a suitable delivery time or a suitable time for you to collect the products from the courier office.

Special Delivery Instructions
We can not leave packages without a signature of someone over the age of 18.

Right to Withhold Delivery
Cocktail Mail reserves the right to withhold delivery of any order for such time and for any reason as Cocktail Mail may determine.

Receipt of Cocktail Mail’s Products
Cocktail Mail is entitled to assume that any person accepting delivery of the Products is authorised to do so by you and is at least 18 years old.

Delays to Delivery
Cocktail Mail (or any employee, contractor or agent of Cocktail Mail.) will not be liable to you or any person for failing to deliver on a timely basis, whether the delay has been due to causes beyond the reasonable control of Cocktail Mail or otherwise.

Change of Address
You must notify Cocktail Mail by email (hello@cocktailmail.co.nz) immediately or within 1 hour of placing the order to have the delivery address changed. Failure to do so within this time may result in delivery to the original desired address andCocktail Mail will not or in anyway be liable.

REFUND POLICY
All sales at the time of the transaction being processed are final, refunds will only be given at Cocktail Mail’s  discretion.Cocktail Mail often purchases items from it’s suppliers immediately after receiving the order so we are not able to cancel.

Damaged Product
If any product is delivered to you in a damaged or spoiled condition, or fails to be delivered due to damage. Cocktail Mail may (subject toCocktail Mail’s agreement that such damage was caused by an act or omission by Cocktail Mail or the Courier) refund you the value of that Product determined as at the date of your relevant order or re-deliver that product. All breakage, Non Delivery or Lost Items must be brought to Cocktail Mail’s attention within 48hrs of the occurrence to remain a viable claim.Cocktail Mail is in no way Liable for replacement of the products if purchaser fails to Track the item and notify Cocktail Mail of any issues within this time frame.

Undelivered Product
If Cocktail Mail fails to deliver any product ordered and paid for by you (Relevant Product), we may, at your request, either:

a) subject to stock availability, deliver (at Cocktail Mail’s earliest opportunity) the Relevant Product to you at no extra cost; or
b) cancel your order for the Relevant Product and refund the actual amount paid for the Relevant Product (determined as at the date of the relevant order).

EMAILS
Upon signing up as a Member to Cocktail Mail you are hereby giving permission for us to send promotional emails to the designated email used upon entering your details, you must reply with the subject being Unsubscribe in order to notify us of your not wanting to receive any further emails.

The contents of this website are at all times the copyright or trademark property of either ourselves, our suppliers or linked third parties and you may not distribute, reproduce, display, publish any trademark or other content of this website for any purpose whatsoever without the prior written approval of us, our suppliers or linked third parties (each as applicable). Furthermore you agree to indemnify us against any claims, costs, damages or losses incurred by us should you fail to comply with clause.
